AMENDED AND RESTATED
10. ARBITRATION OF DISPUTES - If unresolved, disputes
between the Board and unit owners as defined in Section 718.1255 (1),
Florida Statutes, must be arbitrated in mandatory non-binding arbitration
proceedings as provided in the Condominium Act prior to commencing litigation.
Any party may seek enforcement of the arbitrator's final decision in a
court of competent jurisdiction. The prevailing party may be awarded the
costs of the arbitration, reasonable attorney's fees, or both, in an amount
determined at the discretion of the arbitrator.
